What "Sale" and "Sharing" Mean Under the Law

The California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) define "sale" and "sharing" in specific ways that may differ from what you would normally think of those words. Understanding these definitions is important so you can make an informed decision about your opt-out preferences.

"Sale" of Personal Information

Under the CCPA (California Civil Code Section 1798.140(t)), "sale" means disclosing, making available, or transferring personal information to a third party for monetary or other valuable consideration. This is a broad definition that can include situations where data is exchanged for non-monetary benefits, such as receiving analytics services in return for providing user data.

Our Position: We do not sell your personal information to third parties for monetary consideration. We have never received payment in exchange for customer data, and we do not intend to do so.

"Sharing" for Cross-Context Behavioral Advertising

The CPRA (which took effect January 1, 2023) introduced a new concept called "sharing" defined under California Civil Code Section 1798.140(ad). "Sharing" means making personal information available to a third party for cross-context behavioral advertising purposes, regardless of whether money changes hands.

Google (Google Ads, Google Analytics, Google Conversion Tracking)

Google Ads uses cookies and pixels to serve targeted advertisements on Google Search, YouTube, and the Google Display Network. Global Privacy Control (GPC)

We honor the Global Privacy Control (GPC) signal. GPC is a technical standard that allows you to send a universal opt-out signal from your web browser. When enabled, GPC sends an HTTP header signal to every website you visit, telling that website not to sell or share your personal information.

DuckDuckGo Browser: GPC is enabled by default.

Brave Browser: GPC is enabled by default in Brave's Shields feature.

Browser Extensions: Privacy Badger or the GPC browser extension can add GPC support to any Chromium-based browser.

When we detect a valid GPC signal from your browser, we automatically treat it as a do-not-sell-or-share opt-out request with no additional steps required.

After you submit this form, we will send a confirmation email within 24 hours and process your opt-out request within 15 business days. If you do not receive a confirmation, please check your spam folder or contact us at info@bestgaragedoorparts.com.

Processing Time and Confirmation

We are required by the CCPA regulations to process your opt-out request within 15 business days of receiving it. Here is what to expect:

Within 24 Hours

We will send you an acknowledgment email confirming that we have received your opt-out request and that it is being processed.

Within 15 Business Days

We will complete processing and send you a final confirmation email. At this point, we will have stopped sharing your data with advertising partners.

Ongoing

Your opt-out preference remains in effect indefinitely. You do not need to resubmit unless you explicitly choose to re-opt in.

Identity Verification

To protect your privacy, we may need to verify your identity before processing your request. The level of verification depends on your method of submission:

If You Have an Account

We will verify your identity by confirming information that matches your account, such as your email address and recent order history.

If You Are a Guest (No Account)

We may ask you to provide your full name, email address, and any order number or billing details associated with your purchase.

Via Global Privacy Control

If you submit your opt-out through a valid GPC signal, no additional identity verification is required.

We will never ask for sensitive information such as your Social Security number, financial account numbers, or passwords as part of our verification process.

Authorized Agents

You may designate an authorized agent to submit an opt-out request on your behalf. Under the CCPA regulations, an authorized agent must provide one of the following:

Written authorization signed by you designating the agent to act on your behalf, along with proof of the agent's own identity; or

If the agent holds a power of attorney under California Probate Code Sections 4121 to 4130, the power of attorney document must be provided.

If we cannot verify that the agent has been properly authorized, we may contact you directly to confirm before processing the request.

Exceptions to Opt-Out

The CCPA and CPRA include specific exceptions where the opt-out right does not apply:

Contractual Necessity: Sharing information with service providers who need it to perform services on our behalf (payment processing, order fulfillment, email delivery) is not considered "sale" or "sharing" as these providers are bound by contract.

Legal Compliance: Sharing information with law enforcement, government agencies, or as required by subpoena or court order is exempt.

How to Re-Opt In

If you have previously opted out and would like to reverse your decision, you may do so at any time. Under the CPRA, businesses must wait at least 12 months before asking you to opt back in after you have opted out.

Children's Privacy

Our website is not directed at children under 16. We do not sell or share the personal information of consumers we actually know are under 16 years of age.

Under the CCPA, if we had actual knowledge that a consumer is between 13 and 16 years of age, we would need affirmative authorization (opt-in) from that minor or their parent/guardian. Since we require all customers to be at least 18 years old, this provision does not apply to our normal operations.

Appeals and Complaints

If Your Request Is Denied: If we deny your opt-out request, you have the right to appeal our decision. To file an appeal:
